These Terms govern your use of the Storybrush website and the personalised books you order from us. By placing an order or using the site, you agree to these Terms.

1. Who we are

"Storybrush", "we", "us" and "our" refers to Storybrush, trading as Storybrush. You can reach us at info@storybrush.com.au.

2. Acceptance

By using this site or placing an order, you confirm you are at least 18 years old and that you accept these Terms. If you don't accept them, please don't use the site.

3. Orders and acceptance

Each order you place is an offer to buy a Storybrush book. Your order is accepted once we send a confirmation email. We reserve the right to decline an order — for example, where:

• a product was listed at the wrong price
• we can't paint the characters from the photos provided (e.g. faces aren't clear, multiple people in shot)
• the order appears fraudulent or breaches these Terms

If we decline an order after payment, we'll refund you in full.

4. Pricing and payment

Prices are shown in Australian Dollars (AUD) and include GST where applicable. Payment is processed via Shopify Payments and must be received in full before we begin production. We accept major credit cards, PayPal, and Apple Pay.

5. Production and delivery

Each book is made to order and dispatched within 3 business days. Delivery times are estimates only — see our Shipping Policy for detail.

6. Photos you upload

When you upload a photo to Storybrush, you confirm that:

• You own the rights to the photo, or have permission from anyone whose face appears in it
• The subject of the photo is your child, family member, friend or pet — not a celebrity, public figure, or stranger
• The photo does not contain anything illegal, offensive, sexually explicit, violent, or otherwise inappropriate

You retain ownership of your photos. By uploading, you grant Storybrush a limited licence to use your photo only for the purpose of producing your book — including sending it to our AI image-generation provider and printer. We will delete your original photos within 30 days of your book shipping (see our Privacy Policy).

We reserve the right to reject any upload at our sole discretion and refund the order if needed.

7. AI-generated illustrations

Storybrush books contain illustrations created using AI image generation. While we work hard to produce a beautiful, consistent watercolour result, AI outputs can vary. If you're not happy with the painted version of your character, you can regenerate it during the customiser, or take advantage of our 30-day happiness guarantee after delivery.

8. Storybrush intellectual property

The Storybrush name, logo, story content, illustration prompts, software, and original artwork are owned by us and protected by copyright. You may not reproduce, redistribute, or commercialise any of this material without written permission. The personalised book you receive is for your personal, non-commercial use.

9. Customer accounts

If you create an account on our site, you're responsible for keeping your login details safe. Notify us immediately at info@storybrush.com.au if you believe your account has been accessed without your permission.

10. Newsletter

If you sign up to our newsletter, we'll send you occasional emails about new books, behind-the-scenes content and promotions. You can unsubscribe at any time via the link in any email.

11. Consumer guarantees

Nothing in these Terms reduces your rights under the Australian Consumer Law. You have guarantees that cannot be excluded — including the right to replacement or refund for major defects, and to have minor defects fixed within a reasonable time.

12. Limitation of liability

To the extent permitted by law, our total liability to you for any loss or damage arising from your use of the site or a Storybrush book is limited to the amount you paid for the relevant order. We are not liable for indirect, consequential, or special damages.

13. Indemnity

You agree to indemnify Storybrush against any claim arising from your breach of these Terms, your misuse of the site, or content you upload that infringes the rights of a third party.

14. Changes to these Terms

We may update these Terms occasionally. The "Last updated" date at the top reflects the latest version. Material changes will be communicated by email if you've signed up for our newsletter or have an account.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of New South Wales, although nothing prevents you from making a complaint to the Australian Competition and Consumer Commission (accc.gov.au) or the Office of the Australian Information Commissioner (oaic.gov.au).

16. Severability

If any part of these Terms is found to be unenforceable, the remaining parts continue to apply.
